1. What We Do

HealthCareProxyMD's primary service is providing your completed Proxy Package™—your Health Care Proxy and Living Will forms. We guide you through the process of completing these documents based on your state's requirements and help ensure they reflect your wishes.

Optional 45-Minute Call. You may choose to pay for an additional 45-minute video or phone call with one of our doctors for educational and administrative assistance. This call is optional and available for purchase separately from the Proxy Package™.

Your completed Proxy Package™ documents are delivered via email within 48 business hours (or sooner in case of emergencies).

2. Not Medical Advice, Not Legal Advice, No Professional Relationship

Educational and Administrative Assistance Only. Our service provides educational information and administrative assistance to help you complete your Proxy Package™ documents. We do not provide medical advice, diagnoses, treatment recommendations, or legal advice.

No Doctor-Patient Relationship. Use of our website or participation in a call with our doctors does not create a doctor-patient relationship. Our service is not a substitute for clinical care. If you have a medical emergency, call 911 or your local emergency services immediately.

No Attorney-Client Relationship. HealthCareProxyMD is not a law firm, and we do not provide legal advice. No attorney-client relationship is formed by use of our service. While we help you complete legal documents (Health Care Proxy and Living Will forms), you should consult with a qualified attorney for legal questions about your documents or estate planning.

All medical decisions should be made in consultation with your treating healthcare providers, and all legal questions should be directed to qualified attorneys. Our role is to guide you through completing the forms and ensure they meet your state's requirements.

3. M.D. Guarantee and Refund Policy

M.D. Guarantee. We stand behind our service. If you are not satisfied with your physician-prepared Proxy Package™, you may request a full refund within 30 days of delivery of your completed documents.

How to Request a Refund. To request a refund, email us at Contact@HealthCareProxyMD.com within 30 days of receiving your completed Proxy Package™ documents. Please include your name, the date you received your documents, and a brief explanation of your request.

What "Delivery" Means. "Delivery" means the date we email your completed Proxy Package™ documents to the email address you provided. This is the date shown in our email to you.

Refund Process. Refunds are issued back to your original payment method through Stripe. Processing typically takes 5-10 business days after we approve your request. We reserve the right to deny refund requests submitted after the 30-day window or for any request we determine, in our sole discretion, to be fraudulent or abusive.

Refund Limitations. One refund per purchase. Refunds are not available after the 30-day window. We do not offer refunds for chargebacks initiated directly with your bank or credit card company. If you initiate a chargeback, we may dispute it and may not process a separate refund request.

4. Scheduling, Rescheduling, and Cancellations

Payment Required to Schedule. If you choose to purchase the optional 45-minute call with one of our doctors, payment is required to schedule your session. We accept payments through Stripe. After payment is processed, we will email you within 48 business hours to schedule your 45-minute video or phone call.

How to Reschedule. If you need to reschedule your call, please contact us at Contact@HealthCareProxyMD.com as soon as possible. We will work with you to find a new time that works for both parties.

Cancellation Policy. If you cancel your appointment more than 48 hours in advance, you may reschedule without penalty. Late cancellations (less than 48 hours before your scheduled call) or no-shows may result in forfeiture of your session, though we will make reasonable efforts to accommodate rescheduling when possible.

5. Your Responsibilities and Next Steps

You are responsible for:

  • Providing accurate information during your call with our doctor
  • Ensuring that your completed Proxy Package™ documents reflect your true wishes
  • Reviewing your documents carefully before signing them
  • Taking your completed Proxy Package™ documents to your doctor, discussing them with your doctor, and ensuring your doctor reviews them
  • Keeping copies of your documents in a safe place accessible to your Health Care Proxy and family members

Your Doctor's Responsibilities. After you receive your completed Proxy Package™ documents from us, you are expected to show them to and discuss them with your treating doctor. Your doctor is responsible for:

  • Ensuring your Proxy Package™ documents are properly entered into your electronic health record (EHR) or medical chart
  • Ensuring compliance with all applicable local, state, and federal laws and policies
  • Activating and using your documents according to your healthcare system's procedures and legal requirements

HealthCareProxyMD provides the completed documents, but your treating doctor and healthcare system are responsible for the final review, EHR entry, and ensuring all legal and policy requirements are met.

6. Third-Party Services

Our service uses third-party providers to operate:

  • Payment Processing: Stripe handles payment processing. We receive confirmation and basic transaction information, but Stripe processes your card data according to their terms and privacy policy.
  • Scheduling and Communication: We use email and may use third-party scheduling and video/telephony providers for calls. Please review the privacy policies of any third-party services we use.
  • Analytics: We use Vercel Analytics to understand website usage. This service collects anonymous usage data as described in our Privacy Policy.

7. Limitation of Liability

To the maximum extent permitted by law, HealthCareProxyMD and its physicians, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our service.

Our total liability for any claims related to our service shall not exceed the amount you paid for the service.

8. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last Updated" date. Your continued use of our service after changes become effective constitutes acceptance of the updated terms.
